It has come back up, but it is still cheaper than a mortgage payment on a home bought at the peak of the housing market. Many people are shocked that it is often cheaper to short sale and rent that staying in their home with a loan modification.

Here are the two factors that make it possible to rent a comparable or even nicer home for less than their mortgage

Let’s take the example of a home who paid $150,000 for a home that is now worth $75,000. Their mortgage payment was around $1,350 a month.

They stopped paying their payments and moved to a rental. They found a much nicer, larger home to rent for $850 a month. (This was after trying for months to convince their lender to modify their loan.)

The lender wouldn’t drop the payments below $1,200 a month. The house they are renting is selling today for around $95,000.

Someone can buy that house for $95,000 and rent it for $850 a month without losing money. That is what makes it cheaper to rent versus getting a loan modification and staying in your home.

When prices were rising it was actually more expensive to own versus rent. But, everyone wanted to own because their house was supposed to go up in value.

If you are thinking about a loan modification, then first check into the rental market. You will be able to negotiate your loan modification from a position of power.

3. Short Sales do not always go fast. They can drag on for 3-6 months. However, you can still live in the home for free during that time.

The bottom line is that a short sale is a good option for most homeowners. It allows you to get rid of the debt and move on with your life. Many people rent another home for less than their mortgage payment.

In one example, a homeowner in foreclosure found a larger home with a garage. It even had a fenced backyard for their kid. Their mortgage payment was $1,500.

Here is the email from Mark. “I have been working on a Short Sale for almost a year now. The abandoned Home was listed at $103,000 in the beginning.

The price was unrealistic for a virtual tear-down built in 1860. It will take 3 semi trailers to haul off the asbestos alone. We received several offers for $85,000 and $89,000 from the city.

They wanted to buy the 2 acre property to expand the city park. The asking price is now $69,000 and we have had multiple offers.

However the bank keeps on declining these offers because they don’t feel that they are close to the value of the home.

The bank hasn’t done an appraisal and probably has no idea of the true value other than the supporting evidence I have provided to them. Mark.”

As you can see, the bank has lost $15,000 to $20,000 by turning down the previous offers. This kind of stuff happens every day.

The moral of the story is that you need to hire a competent, experienced short sale realtor that can successfully navigate the system.

Paulding County GA – In many cases, short selling your home and then renting or buying it back is considered mortgage fraud. Because loan modifications are so difficult many homeowners are considering selling their home and then renting it from the new owner.

Many homeowners look at this as the best way to get their loan balance reduced.

“I owe 400k, my house is worth 200k, and the bank won’t reduce the amount I owe on a loan modification. I’ll just sell the home to my friend, rent it from him, and then but it back in 2-3 years after I fix my credit”, they think to themselves.

The Bankers are afraid that if this is allowed, then everyone will want to short sale their house and then rent it from the new owner. To discourage this, some banks are now forcing everyone involved to sign affidavits before they will approve the short sale.

The affidavit says something similar to the following: “There is no agreement, oral or written, between the seller and buyer which allows the sellers to remain in the property as tenants or to regain ownership of the property at any time after the property sells.”

The bottom line is that the banks don’t like short sale leasebacks. If they find out after closing, then you could face criminal prosecution. How exactly?

Well, have you read your entire 18 page mortgage from front to back? Have you read the entire short sale approval letter and all the other short sale documentation? A clause could be anywhere in the paperwork and cause you lots of issues down the road.

So, are short sale leasebacks illegal? I don’t know for sure. I definitely would not do it if I had to sign an affidavit like the one above. If there is nothing like that, then talk to a competent attorney first.

But, even a good lawyer can’t guarantee you won’t face future legal and/or criminal problems. They can only give you their opinion. Many attorneys have different opinions on a legal subject.

The only person’s opinion that matters is a judge who makes the decision on the case. If you are considering a short sale leaseback, then I would simply recommend short selling and renting another home until you can buy again.

Show your lender that a lot of repair work is needed to bring the property back up to a marketable condition so it can be sold. Lenders are simply not set up to get any repair work done.

They are in the loan business, not the repair or handyman business. It really doesn’t matter the type of house or condition, all mortgages can be discounted.

The very best types of properties to perform short sales on are houses that are in rough shape and need repair work because the bank will often allow a bigger discount for it.

You will need to consult with an independent attorney, not the buyer’s attorney. Deeding your property will render you powerless.

The new owner will always have control and as such they can do anything with the property, including renting it out and keeping the rent, or even attempting to sell it to make profit.

This may in return have a negative financial impact on you because the new owner might not make your mortgage payments. As you well know, this can cause huge damage to your credit.

Mistake #2: Selling your home at a huge discount.

Take time to explore your options especially when your foreclosure sale is more than 45 days away. Take a day or two making phone calls just to try and find an appropriate solution for your situation.

Do not allow a buyer to push just to get you sell them your property. In such a case, the deal will most likely be favorable to them and not to you. Equity in your home belongs to you.

Mistake #3: Authorizing a prospective buyer to deal directly with your lender.

The buyer will always ask your lender to accept a discounted payoff. The negotiations may be longer than expected and if they fail to agree, the buyer may decide not to buy your property.

This could waste time for you. Before you realize, you may not have time to resolve the situation and avoid foreclosure. In addition, not knowing what goes on between the buyer and your lender may be detrimental to you.

It may happen in such a way that the buyer could handle the negotiation and presentation of information in a way that makes it very difficult for you to resolve your loan situation later.

Paulding County GA – A home owner thinking of a short sale recently asked us why they should short sale versus just walking away and letting their lender foreclose on the home. We gave them the normal answer: “It’s much better for your credit.”

That was the first thing that popped into our head. But, I knew there are more benefits to a home owner than simply better credit. So I put together the entire list and here they are.

1. The upside down debt is erased in most cases. If you are selling because of a financial hardship, then the upside down debt will be automatically erased in most cases. Is your loan is owned or insured by the following agencies: Fannie Mae, Freddie Mac, FHA, and or VA? If you are short selling because of a financial hardship, their policies state that your debt will be erased.

2. You are eligible to buy another home much sooner compared to a foreclosure. The most common loan program, Fannie Mae, stipulates that you can buy another home under their program in 2 years. FHA, a popular low down payment loan program stipulates that you can qualify for an FHA loan within 3 years.

3. No Cost To You. That is right. A short sale costs you nothing. All of the expenses are paid for by your lender. That includes the title insurance, any county taxes or fees on the sale, attorney fees, and the Real Estate Agent. If the lender foreclosed on the house and then tried to sell it, they would have to pay all the costs. So why not pay the costs with a short sale?

4. Your credit suffers less damage. Most people think that a short sale will be the kiss of death to their credit. That is the one big advantage of a short sale over a foreclosure.

Upon completion of the short sale, your credit score will drop between 50 and 100 points. However it will rebound fairly quickly. The other benefit is that you will have less debt. (A lot of debt hurts your credit score.) You will have a lower debt to income ratio, which will boost your credit.

In a couple of years your credit will be back to normal and you can buy another home. In addition, anything and everything bad on your credit can be fixed thru the dispute process.

5. You can often rent a comparable house for less than your former mortgage payment. In one example, a homeowner in foreclosure found a larger home. It even had a fenced backyard for their kid and a garage. Their prior mortgage payment was $1,500. They rented the nicer, bigger house for $850 a month.

6. You avoid the humiliation of a foreclosure.

7. You don’t have to pay rent during the short sale process. A short sale can take up to 6 or 9 months. Not all of them do. But, some do. If you aren’t concerned about your credit, then you can stop making your mortgage payments during the short sale. You can use the savings for the deposit on a rental.
